Terms of Service

1Agreement

These Terms of Service ("Terms") are a binding agreement between you and the operator of PostWallah named in the Contact section ("PostWallah", "we", "us"). They apply to the PostWallah app and every service we provide through it.

By creating an account, signing in or using PostWallah, you accept these Terms and our Privacy Policy, Content Policy and Refund & Cancellation Policy, which form part of these Terms. If you do not agree, do not use PostWallah.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not need a physical or digital signature.

2Who can use PostWallah

• You must be at least 18 years old and able to enter a binding contract under Indian law.
• If you use PostWallah for a business, you confirm you are authorised to act for it, and the business is bound by these Terms too.
• You must not use PostWallah if we have suspended or closed your account before, or if the law prohibits you from using it.
• We may refuse, limit or stop service to anyone, subject to applicable law.

3Your account and security

• You sign in with your mobile number and a one-time password (OTP). Use only a number you own and control.
• Never share your OTP with anyone. PostWallah will never ask you for it by call, message or email.
• You are responsible for all activity on your account and for keeping your phone secure. We are not liable for any loss caused by you sharing your OTP or phone, or by someone else using your phone or SIM.
• Tell us at once if you think someone else has accessed your account.

4What PostWallah does

PostWallah provides greeting and post designs ("templates"), tools to add your own name, photo, logo and details, AI photo tools, and ways to save and share the finished images.

PostWallah is a tool. You decide what to create, what to put on it and whom to send it to. We do not check, approve or endorse the posts you make. For content you upload or share, we act as an intermediary under Section 79 of the Information Technology Act, 2000.

5Your content is your responsibility

Your content means everything you add: photos, cut-outs, business logos, names, numbers, emails and text, and the posts you create and share.

• You keep ownership of your content. You alone are responsible for it, for its accuracy and legality, and for every post you share and every person you share it with.
• You confirm that you own your content or have every permission needed to use it, including consent from each identifiable person in your photos and, for a child, from their parent or guardian.
• Use only logos, brand names and trademarks that you own or are authorised to use.
• Do not put anyone else's phone number, email or other personal details on a post without their permission.
• Check every post before you share it: names, spellings, numbers, dates, festivals, claims and images. We are not responsible for mistakes in posts you create or share.
• Content that breaks our Content Policy or the law may be removed, and your account may be suspended.

6Permission you give us

So that PostWallah can work, you give us a non-exclusive, worldwide, royalty-free licence to store, copy, process (including background removal and AI generation), resize, display and transmit your content. We use it only to provide, secure and improve PostWallah and to do what you ask, such as sharing.

This licence ends when you delete the content or your account, except for copies already shared, copies in backups until they expire, and copies we must keep by law. We do not sell your photos, and we do not use them in our advertising without your separate permission.

7Templates and our rights

• PostWallah's name, logo, software, templates and artwork belong to us or our licensors and are protected by law.
• We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use templates inside the app to create posts for your own personal or lawful business greetings.
• You must not sell, resell, sublicense or distribute templates, or posts as templates; extract, scrape or copy the template library; remove or hide watermarks; use our artwork in your own logo or trademark; or claim it as your own.
• A paid plan gives you access to features, not ownership of any template.
• Festival, religious and occasion content is for greetings only. We may add, change or remove templates at any time.
• A post showing a person, logo or brand does not mean they endorse you or PostWallah.

8AI photos

• AI photos are created by third-party AI models. Results can be inaccurate, unexpected or unflattering, may not look like you, and may resemble other people or works. We do not guarantee any result.
• Upload only photos of yourself, or of others who have given you permission. Do not upload a child's photo unless you are their parent or guardian.
• Do not use AI photos to impersonate anyone, create sexual or intimate images, or mislead people, or present an AI image as a real photograph to deceive.
• You are responsible for how you use any AI photo. We may refuse, block or remove any request or result.
• Credits are used as shown before you start. If a generation fails, its credits are returned automatically. We do not refund credits because you don't like a result.
• Use "Report photo" on an AI photo to tell us about harmful output.

9Sharing and public image links

• When you share, the image goes to the app and people you choose, such as WhatsApp. Their terms and privacy policies apply, not ours.
• Once a post is shared, we cannot recall, edit or delete the copies others receive. Anyone who receives it can see and forward everything on it, including your phone number or email.
• Uploaded photos, logos, cut-outs, AI photos and saved post images are stored at web links that anyone with the link can open without signing in. The links are hard to guess but are not secret. Do not upload anything you need to keep private, such as ID cards, documents or intimate photos.
• We are not responsible for what recipients, other apps or platforms do with content you share.

10Plans, trials and payments

• Some features need a paid plan. AI credits are bought separately. The price, taxes, billing period, trial and renewal terms are shown before you confirm a purchase, and that offer is what applies.
• A paid trial turns into the paid plan automatically when it ends, unless you cancel before then.
• Plans renew automatically at the end of each billing period until you cancel. If you pay by UPI AutoPay or another mandate, you authorise us and our payment partner to charge each renewal as shown when you set it up. You'll get a notice before each charge, as the payment rules require.
• Keep enough balance or limit for renewals. If a payment fails, paid features may stop.
• We may change prices or plans for future billing periods, with notice in the app. If you don't agree, cancel before the change applies.
• AI credits and free allowances have no cash value. They cannot be transferred, sold or exchanged for money, and can only be used in PostWallah. Unused credits are lost if your account is deleted, or closed for breaking these Terms. We may correct credits given by mistake.
• Free features, trials and allowances may be changed or withdrawn at any time.
• Payments are processed by our payment partners. We never see or store your card number, UPI PIN or bank passwords.

11Cancellation and refunds

You can cancel at any time, and your plan stays active until the end of the period you've paid for. Deleting the app, logging out or deleting your account does not cancel a subscription or UPI AutoPay mandate. Refunds are given only as set out in our Refund & Cancellation Policy.

12Acceptable use

You must follow our Content Policy. You must also not:

• break any law, or use PostWallah for fraud, spam, scams or misleading promotions;
• try to access other people's accounts or data, or our systems, without permission;
• copy, reverse engineer, scrape, overload or interfere with the app or its servers, or get around any limit, payment or security feature;
• use bots or other automated means to create accounts or content;
• create more than one account to misuse trials, free allowances or offers.

We may investigate misuse, remove content, suspend or close accounts, and report unlawful activity to the authorities and cooperate with them.

13Availability and changes

• PostWallah is provided "as is" and "as available". It may be interrupted, contain errors or lose data, and may not work on every device or network.
• We may change, suspend or stop any part of PostWallah at any time.
• Keep your own copies of anything important. We are not responsible for lost drafts, posts or images.

14Disclaimers

To the fullest extent permitted by law, we give no warranties of any kind, express or implied, including about quality, accuracy, fitness for a particular purpose, availability or non-infringement.

• Templates and AI photos are for general greetings and communication. They are not professional, legal, religious or business advice.
• Festival dates, timings and other information in templates may be wrong. Check them yourself.
• We do not promise any business result, reach or response from your posts.
• We are not responsible for services we don't control, including app stores, payment and UPI providers, banks, telecom and SMS networks, AI providers and the apps you share to.

15Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill, reputation or data.
• We are not liable for your content or the posts you share; mistakes you did not correct before sharing; what recipients or other platforms do; AI results; use of your account through your phone or OTP; or events beyond our reasonable control.
• Our total liability for all claims relating to PostWallah is limited to the amount you paid us for PostWallah in the three months before the event that gave rise to the claim.

Nothing in these Terms limits liability that the law does not allow us to limit, or consumer rights that cannot be waived.

16Indemnity

You agree to indemnify and hold harmless PostWallah, its owners, employees and partners against all claims, losses, damages, penalties and costs (including reasonable legal fees) arising from your content, the posts you create or share, your breach of these Terms or any law, your infringement of anyone's rights, or the use of your account.

17Suspension and termination

• We may suspend or close your account, or remove content, at any time and with or without notice, if we reasonably believe you have broken these Terms or the law, if you create risk or legal exposure for us, or if the law requires it.
• If your account is closed for breaking these Terms, you are not entitled to a refund of fees or credits.
• You can stop using PostWallah at any time and ask us to delete your account.
• Sections that by their nature should continue survive termination, including those on your content, payments, disclaimers, liability, indemnity and disputes.

18Complaints and grievances

If you have a complaint about content or the service, contact our Grievance Officer (see Contact). We acknowledge complaints within 24 hours and aim to resolve them within 15 days, as the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 require. Complaints about content that shows a person in a sexual or intimate way, or impersonates them, are acted on within 24 hours.

19Governing law and disputes

These Terms are governed by the laws of India. If you have a dispute, contact us first and give us 30 days to try to resolve it. Subject to that, the courts in the city of our registered office (see Contact) have exclusive jurisdiction. This does not take away any right you have to approach a consumer commission or other authority under applicable law.

20Changes to these Terms

We may update these Terms. We'll show the date of the latest version and tell you in the app about important changes. If you keep using PostWallah after a change takes effect, you accept the updated Terms. If you don't agree, stop using PostWallah and cancel any plan before it renews.

21General

• These Terms, with the policies they refer to, are the entire agreement between you and us about PostWallah.
• If any part is found unenforceable, the rest stays in effect.
• If we don't enforce a right, we have not given it up.
• We may transfer our rights and duties under these Terms, for example in a sale or reorganisation. You may not transfer yours.
• We are not liable for delay or failure caused by events beyond our reasonable control, such as network or power failures, outages at our providers, natural disasters, epidemics, government action or strikes.
• We may send you notices in the app, by SMS or by email. If these Terms are translated, the English version prevails.
